SUNY-wide Mathematica Licensing Agreement
Summary of User Terms

1.     The Software being licensed by SUNY is:
a.      Mathematica 5 for Class A, X and B platforms, as well as all updates, upgrades and new releases of the products:
            i.      Class A includes Windows 95/98/Me/NT/2000 and Macintosh
            ii.      Class X includes Linux (Intel or PowerPC)
            iii.      Class B includes SG, HP-UX PA RISC, IBM RS/6000, Sun Solaris, Digital Unix, Linux (Alpha)
b.      webMathematica Amateur Version (see FAQ for further information on webMathematica)
c.      If any platforms are generally added by vendor to the Classes licensed, SUNY will be licensed for the additional platforms.  If any platforms are generally removed from the Classes, support for the removed platforms will no longer be provided to SUNY.

2.      Campus is licensed to copy and distribute the Software for use:
a.      On  computers that are (1) owned and/or under the control of the campus; (2) located at a facility owned or under the control of the campus; (3) for the sole use of Authorized Users; AND (4) used primarily for teaching or instructional purposes.
b.      Only by Authorized Users, who are defined as faculty members, staff who directly support faculty, and students.  Administrators and staff who do not directly support faculty for instructional purposes are not licensed.
c.      On the home computers of all Authorized Users (as defined in b), including students.
d.      This agreement does not permit the use of the Software at federally funded research laboratories or other organizations where the primary mission is not the direct teaching of students.  If, however, such a facility is used by Authorized Users in credit-bearing courses, the Software may be used at those facilities, ONLY by Authorized Users, and ONLY for teaching/learning purposes.

3.      Authorized users may not:
a.      distribute the Software to individuals who are not authorized users.
b.      disassemble, decompile or reverse engineer the Software.

4.       webMathematica special terms:
a.      Licenses the user to incorporate some of the power of Mathematica into a website available to the general public by linking an interface to a webMathematica kernel.
b.      Campus may not deliver Mathematica itself or its overall functionality to the general public on a website or through the use of multiple sites.
c.      Any website created using webMathematica may not replicate the “look and feel” of Mathematica.
d.      The use of webMathematica under this agreement may not be for commercial gain
e.      Campus must provide a Mathematica web link on any site it creates through the use of webMathematica
f.        Campus must inform Mathematica of the URL of any website(s) using webMathematica, together with contact information for an individual responsible for the website(s).
g.      Any campus responsible for a website that does not conform with these terms may lose its right to use webMathematica.

5.       The Software will be provided to the License Manager identified by the campus.  The License Manager will be responsible for distributing the software to the campus’s authorized users.
a.      Software is provided with passwords that are valid for 12 months.
            i.      New passwords will be provided by ITEC annually.
                        ii.      Passwords may not be posted publicly, either electronically or otherwise.
b.      The campus is entitled to all upgrades, new releases and documentation that become available while the campus participates in this licensing program.
c.      The campus may distribute copies of the Software to authorized users through download from a server, or by distributing CD’s.
                          
i.      Each copy must retain all copyright information.
                        
ii.      All students who receive a copy of the software for home use must be given a copy of the Mathematica License Agreement (attached).
d.      Faculty desiring Software for home use may contact Mathematica directly to request the Software.  They should use their campus email address in making the request so that Mathematica may easily verify their affiliation with a participating campus.
e.      Documentation may not be duplicated.  It may be purchased from the vendor for approximately $50 per kit.  However, electronic documentation is provided with the software in the form of the Help utility and is therefore included with each copy of the software distributed.

6.     The campus’s Technical Coordinator will be authorized to contact ITEC with any technical questions.  Campus users must contact the Technical Coordinator with questions.

7.      When either the SUNY/Mathematica agreement ends, or the campus terminates its participation:
a.      The campus must destroy all copies, and delete all copies installed on campus-owned and operated machines.
b.      Faculty and academic support staff must stop using the software on their home machines and delete it.
c.      Students may continue to use the last version installed on their home computers.
